Sydney Dude Sues Over Missing Pizza Delivery; Is Awarded $1200 In Damages

A Sydney dude has been awarded $1200 in damages from Domino's, after suing them for a pizza delivery that never arrived.

According to the Daily Telegraph, Tim Driscoll - a Domino's shareholder and lawyer - wanted to "teach them a lesson" when his order of three pizzas, two garlic bread and two 1.25 litres of Coke never arrived.

After twelve months of seeking a refund, he decided to take them to court for "breach of contract"; it was a startling display of initiative from someone who decided against 'pick-up'.

Though the court judgment may seem extreme, it covers only his legal fees, the initial cost of the missing pizza order ($37.35) and a settlement of $125.

And yet, eighteen months after the order was initially made, the legal drama looks to continue, with Domino's pledging to apply for an overturning of the judgment, and Driscoll asking the Australian Competition and Consumer Commission (ACCC) to prosecute the company for breaching consumer laws.
